Terms an conditions for rental EASY
The Client must read and confirm the present rental terms by signing the contract. The Client must agree with all the clauses of this contract. EASY RENT reserves the right to refuse the rental or the extension.
Contract – the document signed by the Client/Renter and by EASY RENT, includes information from the following documents: Rental Contract, Terms and Conditions of Rental, Hand Over- Take Over Report and full specifications in the Appendixes to the contract.
Car/Vehicle – it represents the vehicle offered for rent with all its accessories.
Client or renter – the person who rents the vehicle
Fuel – diesel or gasoline, depending on the type of car rented.
User – the person mentioned in the Contract, who may drive the vehicle rented by the Client.
Partner – legal person who mediates renting between EASY RENT and the Client
Collision Damage Waiver (CDW) limits the driver’s liability in the event that the rental car is damaged, subject to the terms of the rental agreement.
Rather than the full cost, the driver is generally only responsible for the first portion, known as their ‘excess’.
Third-Party Liability (TPL) Third-Party Liability (TPL) covers the driver’s liability for damage to any property, excluding the rental car itself. TPL also covers injuries suffered by other people, whether or not they are in the rental car, subject to the terms of the rental agreement.
Theft Protection (TP) Theft Protection (TP) limits the driver’s liability for costs incurred by the theft of the rental car – or damage incurred by the theft or attempted theft – to an ‘excess’ amount, subject to the “Terms and conditions” of the rental agreement. TP does not cover personal effects, which may be covered by the driver’s own travel or household policies.
SCDW/ SCDW+ – fee for reducing the liability in case of damage or theft detailed in chapter 4
2.1. To give the Client the right to use the vehicle which is the subject to Contract by: handing over the vehicle, completing and signing the handing over and taking over report, giving the keys and car documents (registration certificate, RCA insurance policy) in original/copy.
2.2 Sa predea autovehiculul Clientului in buna stare de functionare si in acord cu normele tehnice ale fabricantului, pe baza Fisei de Predare-Restituire.
2.3. To provide the Client with roadside assistance in Romania during the entire contractual period, 24h/24, 7days/7 in case of accident or mechanical breakdown.
2.4. To replace the vehicle (subject to availability), in case of damage that cannot be repaired on the spot, if the damage is not the fault of the Client, within a period of 48 hours, depending on the location where the fault was found.
2.5. If EASY RENT will be unable to replace the Vehicle, the Client will be refunded the cost related to the rent calculated in proportion to the period the vehicle could not be used.
2.6. EASY RENT is not responsible for losses incurred by the Client in case of failure or damage to the vehicle, except the expenditure authorized by EASY RENT for repairs.
2.7. Since the car delivery and up to repossession EASY RENT is exempt from liability for damage caused in traffic by the vehicle rented to the Client, as well as for road or bridge tolls or fines resulting from encroaching a parking space, violation of the road laws or Romanian laws.
3.1. To be 19 years old, to be the holder of a national and/or international valid driving licence (it is mandatory to have an international license for documents issued in countries with different writing than the Latin alphabet and those obtained by right-hand drive, Ex. UK, Australia, Japan.). On signing the Contract, the driving license together with an identity document and a credit card must be presented in original. Using credit card is required for blocking the deposit VISA/MASTERCARD/MAESTRO.2.2. Drivers with experience between 0-1 years will be charged a fee as follows: € 300 for classes A, B, C, D, D2, E, F and € 500 for classes F1, G, G2, P, P1, P2, L, L1. Drivers with experience between 1-3 years will be charged a fee of € 100 for classes A, B, C, D, D2, E, F and € 300 for F1, G, G2, P, P1, P2, L, L1. The fee will be applicable per lease, regardless of its duration. If there are additional drivers in the same conditions, with an experience between 0-1 years, 1-3 years respectively, the fee shall be charged only once.
Age Restrictions: Minimum rental age is 19 years for Economy, Compact, 24 years old for other classes. Under-Ages between 19-24 and Senior Drivers, over 65 years old, are surcharged with € 10/day, up to maximum of € 100/rental. Driver’s License: All Clients and Drivers must present a valid drivers license at the rental counter. Additional Drivers must meet all qualifications as the primary driver in regards to age and license requirements. Charges for additional drivers – € 15/rental. Maximum 2 additional drivers are allowed per vehicle and all are subject to € 15/rental but also age restrictions.
3.2. To allow only persons authorized and mentioned in the Contract.
3.3 To not drive the vehicle off the roadway surfaces, unpaved roads, non-cemented roads, roads closed to public traffic. Otherwise, EASY RENT will receive partially or fully the minimum deposit (including for SCDW/SCDW+)
3.4. To not perform and allow technical or aesthetic interventions without the written consent of EASY RENT.
3.5. To notify EASY RENT, upon its request, on the whereabouts of the vehicle and to allow vehicle inspection by representatives of EASY RENT, within 24 hours of request.
3.6. To not use the vehicle for taxi, driving school, activities of pushing or towing, racing, training, competitions or for the purpose of transporting hazardous substances or illegal activities that can damage the condition of the vehicle, as to not give any purpose other than for passenger transport in leasing regime. If the leased vehicle is seized or destroyed/damaged by the authorities or the Client, as a result of its use for the purpose of obtaining undue benefits by transporting objects or prohibited substances, the Client will be liable for the entire value of the vehicle.
3.7. Pets (for instance: dogs, cats) can be transported in EASY RENT cars only in special boxes (cages, bags) closed during the trip.
3.8. Besides the natural working wear of the vehicle, the Client will be responsible for any damages brought to the rented vehicle during the Rental Period and will cover any repairing costs (no matter who is guilty) and financial damages suffered by EASY RENT because of the repairing the vehicle (for example losing other booking agreements). The value of the damages suffered by EASY RENT because of the repairs will be equal to the normal rental fee assigned to the rental period in which the car is not being used. Also, the Client will cover all the administrative(documents) costs of the damages.
3.9 The Client will notify as soon as possible EASY RENT regarding the loss of the vehicle, damages or problems to it. If further damages are to appear, the Client is not allowed to use the vehicle without the permission of EASY RENT.
3.10 The Client must take care of the vehicle, making sure that it is properly closed and secured when not in use, that it is properly secured from bad weather conditions
3.11 The Client has to make sure that he/she properly fuels the vehicle, knowing the type of fuel it needs, must verify and maintain an adequate oil level, must verify and maintain the proper tire pressure, must verify the level of the cooling liquid. In contrary, the Client will be responsible for all the damages caused by the above mentioned.
3.12 The Client has to make sure that the rented vehicle is used in legal conditions and in accordance to the manufacturer’s recommendations. The Client will not overload the vehicle beyond the legal limit or the manufacturer’s limit. The Client will not use the car for transporting passengers over the law limit or manufacturer’s limit.
3.13 The Client will insure the goods that he/she carries with rented vehicle and will not transport dangerous, toxic or inflammable goods
3.14 The Client will not use the rented vehicle for car towing or other activities that are not approved by this rental agreement, EASY RENT, the law / authorities or the manufacturer’s recommendation.
3.15 The Client will not use or drive the rented vehicle in illegal means, will not use or drive the rented vehicle under drug use, alcohol use, medication use or any other toxic substance use.
3.16. The Client is NOT allowed to sell, rent or foreign the rented vehicle.
3.17. Except repairs that cost less than the amount of the „Excess” or „Deposit” mentioned in the Rental Agreement, the Client is not allowed to repair or allow repairs of the rented vehicle without the approve of Premium Rent. The minor repairs must be solved by an authorized mechanic approved by Premium Rent.
3.18. The Client has to cover the cost of fees and penalties caused by using the vehicle outside the law of conditions of this Rental Agreement. The Client will cover administrative costs resulted from legal responsibilities (for example police fines, traffic fines).
3.19. The Client will not allow the car to be driven by other persons, in the following cases:
– person who do not have a valid driver licence, he does not have the driver licence in his possesion, he does not have 21 years old and the licence driver is no longer than one year old;
– person which is under the influence of alcohol, drugs, or other medicines and substances which may cause temporary lose of driving capacity.
3.20. Rentals outside Romania require EASY RENT written consent and are subject to special conditions. To obtain the documents necessary to transit borders, a fee of € 50 will be charged.
3.21. To use the rented vehicle according to constructor recomandations and EASY RENT indications.
3.22. For the noncompliance with the obligations of the Client – provided in Chapter 3 EASY RENT is entitled to unilaterally cancel the reservation without refund of amounts collected in case of advance payment) the full deposit guarantee shall be collected (including for SCDW fees).
4.1. The delivery and return of the vehicle shall be made at the place, date and time agreed between EASY RENT and the Client and mentioned in the reservation form and the Contract. At the delivery of the vehicle the delivery-returning report will be signed in 3 (three) copies. One will stay for EAST RENT and 2(two) copies for the Client. At returning of the vehicle the 2(two) copies in possession of the Client will be signed and each part will receive one copy. Restitution is effective upon signing delivery-returning report by the EAST RENT and the Client.
4.2 The return of the car in a different place than the one it was delivered shall be made only with EASY RENT consent and can generate additional fees that will be collected by EASY RENT from the deposit guarantee if the client decides the location of handing over the vehicle after taking over it.
4.3. For vehicles returned outside office hours (weekends and/or by night) or in weather conditions that prevent the car inspection, the Client’s responsibility for any damage and the release of security until noon the next working day will be extended.
4.4 The Client abandoning the vehicle under different conditions than it was taken over in the report, without handing over the key to a representative of EASY RENT and without signing bilaterally the delivery-returning report will attract the liability within the security limits specific to each car type.
4.5. Parking fees during the vehicle delivery-returning in another location than the one stated in the Contract as well as parking for the entire duration of use of the car rented from EASY RENT are borne entirely to the Client. It will bear along with the parking costs, all taxes required by law, both in Romania and in other countries, road and bridge tolls, stationary tolls in airports or special areas with limited duration, fine resulted from breaking traffic rules. In case of non-payment of the above, EASY RENT will pay the fines resulting from the Client’s failure to fulfil the obligations. EASY RENT will invoice the Client the effective value of the fine plus an administration fee of € 50/fine.
4.6. The client is held to return the car with the same amount of fuel it had at the beginning of the rental period. Otherwise, following a written notification from EASY RENT, the client agrees to pay an alimentation fee of Euro 50.00 and the equivalent of the missing fuel, at the price of 1,5€/l No credit is given for extra fuel as compared to the initial amount of fuel provided by EASY RENT.
4.7. If the Client fuels the rented vehicle with another fuel than indicated by the manufacturer (as noted in the registration certificate) the client is held to pay a service charge in the amount of 50 Euro, the cost of transport on platform, the cost of immobilization days in service, the cost of repair according to the repair estimate and the appropriate refuelling. (including the clients who opted for SCDW/SCDW +).
4.8. Rentals outside Romania require EASY RENT written consent and are subject to special conditions. To obtain the documents necessary to transit borders, a fee of € 50 will be charged.
4.9 The safety deposit for leaving the country is Euro 1000 minimum and Euro 5000 maximum.
4.10. In case of fault and/or road events occurred outside the country, the Client, according to the report signed upon taking the car over, must return the car within the borders of Romania bearing the full cost.
4.11. Traveling abroad is allowed only within the European Union and European Economic Area. Should this obligation be breached, in the event of damage or theft, the Client will be responsible for the entire value of the car.
4.12. The Client is responsible for the rented vehicle until he/she returns the vehicle and its keys to Premium Rent. If the Client returns the rented vehicle at the agreed location when closing hours, then the client is responsible for the rented vehicle until the location is open and the keys are returned to Premium Rent in terms according to this rental agreement.
4.13. In case of fault and/or road events occurred outside the country, the Client, according to the report signed upon taking the car over, must return the car within the borders of Romania bearing the full cost.
4.14. Upon taking over the car by the Client, the car cleanliness status shall be specified, and the Client shall sign the report containing these mentions of the car’s interior. Where upon return the vehicle requires more than the standard procedure of washing in order to restore the status before renting, the Client agrees to pay administration fees of €50 added to the services of car wash, according to the invoice and tax bill attached and send to the Client by e-mail no later than 48h.
4.15. EASY RENT rents the car with a range of accessories consisting of GPS, child seat, snow chains, Wi-fi router according to the following rates:• GPS 5 €/day, maximum up to 50 € • Snow chains 3 €/day, maximum up to 30 € maximum• Child Seat 3 €/day, up to 30 € maximum • Wi-fi Router 5 €/day etc
4.16. In case of loss or damage of keys, original documents or car accessories, loss of parking ticket or loss of registration plates by the Client, EASY RENT will receive from the Client the value of objects damaged/lost from the price of the purchase invoice of each accessory, or the amount of the fine that a client must pay, plus an administration fee of €50
4.17. At returnal there is a grace period of 60min. After this therm all days will be charged as for the rental rates plus an additional fee of 100€.
4.18. EASY RENT will not be held liable for any objects forgotten in the vehicle by the Client and unidentified upon the vehicle handover.
4.19. Smoking in EASY RENT cars is strictly forbidden. In case of non-compliance, a fee of €100 will be charged.
4.20. Urmatoarele situatii sunt asimilate furtului autovehiculului savarsit de catre Client
a) depasirea termenului de restituire a autoturismului cu peste 24 ore, in lipsa unei intelegeri intre parti privind prelungirea perioadei de inchiriere si plata contravalorii acestei prelungiri.
b) lipsa sesizarii Organelor de Politie in cazul disparitiei autovehiculului, lipsa confirmarii plangerii din partea Politiei si neprezentarea cheii originale / documentelor masinii.
5.1. The vehicle has an RCA insurance policy, according to the law.
5.2. The client chooses one of the following warranties and warranty reduction fees upon signing the contract:Collision Damage Waiver (CDW), Theft Protection (TP) included in price, Super Collision Damage Waiver (SCDW) or Super Cover Plus (SCDW +)
5.2.1. Collision Damage Waiver (CDW) represents a franchise for damage (responsibility), also called damage deposit (specified in Public Tariffs), which may vary between 500 euros and 2,000 euros depending on the class of the vehicle specified in the contract signed by the Parties. The mandatory deposit shall be submitted upon signing the contract, it will be blocked by the EASY RENT on a credit card and will be reimbursed to the Client upon the return of the car (except the cases provided in Section 5.4.).
5.2.2. “Theft protection” (TP) is a theft protection which is designed to limit driver’s liability for costs arising from theft or attempted theft of the vehicle rented, within the limit of security afferent to the class set out in the rental contract. Protection against theft does not cover personal belongings of the driver that can be covered according to the travel policies.
5.2.3. Super Collision Damage Waiver (SCDW) represents a warranty reduction fee referred to in section 5.2.1, whose daily rate is found in the rental contract. By paying a SCDW fee, the client’s responsibility in case of damage and/or theft for the rented vehicle is reduced from the value of the above mentioned security to the amount of Euro 150.00 for cl. A-V and EUR 330.00 for cl. P to cover any additional costs, except as mentioned in Chapter 5 of this Contract.
5.2.4. Super Cover Plus (SCDW +) is a superior warranty reduction fee that eliminates entirely the client’s responsibility in case of accident and/or theft.
5.3. If one of the users mentioned in the contract is between 18 and 25 years or above 70 years, he/she is charged a double guarantee. In this case, the warranty could not be reduced by the payment of the SCDW or SCDW+ fee.
5.4. If agreeing for CDW / SCDW, the warranty (deductible) for damage is invoiced by EASY RENT to the Client in the following conditions:
a) damages (accidents) caused to the rented vehicle, ascertained by the competent bodies of Police, as the fault of the Client or an unknown author (including the situation in which the vehicle is found damaged or vandalized in the parking lot).
b) theft of the rented car
c) as well as any other exclusions from insurance policies and the damage table which is part and parcel of the terms and conditions.
Regardless of the paid warranty reduction fee for which the Client has opted, he/she becomes responsible and liable for compensation and payment of collateral damage in the following situations:
• failure to comply with the obligations stipulated in Chapter 3• lack of fuel (chpt4.6)• loss of car documents/key/accessories € 100 (article 3.13)• damage to the passenger compartment (excessive soiling, staining or damage to the seats)• damaging/losing the accessories offered for rent (GPS, child seat, etc.)• damage to the lower part of the vehicle• wrong fuelling of the vehicle• wheel or tire damage• partial or total damage caused as a result of smoking inside the car and/or while it is near flammable environments
7.1. The Client fully pays upon signing the Contract, the rental (car and several options rented), the warranty reduction fee (if he/she has chosen one) and any additional fees fixed by the report.
7.2. Rental payment can be made by card(VISA, Maestro, Mastercard) of or cash. Warranties can just by payed by card.
7.3. Prices do not include fuel costs, road tolls except vignette which is included in the rental fee, fines for breaking traffic regulations on public roads and national legislation in force or costs resulting from the action of local authorities regarding the vehicle which is the subject of this Contract, during the rental period. Full payment of these amounts will be charged to the Client.
7.4. The client must pay all financial obligations remaining under the Contract, when returning the vehicle, based on the payment document issued by AEASY RENT.
7.6. Any amount unpaid by the Client to AEASY RENT at the end of the Contract may be charged by AEASY RENT from the credit card of the client with prior written summons. Any amount collected in the absence of the client, with his consent by signing the present conditions, ends with the transmission of an email from AEASY RENT containing receipts afferent to cashing.
7.7. In case of delayed payment over the term stipulated in the Contract, penalties amounting to 1% of the amount due for each day of delay shall be paid.
7.8. In the case of unilateral renunciation of the contract by the Client, prior to the agreed contractual period, he/she will not be reimbursed the services.
8.1. The Client must immediately notify AEASY RENT and report to the police any damage discovered to the rented vehicle.
8.2. If damage has unknown author, the Client must obtain, prior to returning the car, a Repair Authorization from the police.
8.3. If the accident was the fault of the Client, upon the vehicle handover he has the obligation to submit both the Repair Authorization and the Report issued by the police; the Client must also give a written statement to the AEASY RENT headquarters.
8.4. If the client or another road user is responsible for the accident, the Client must complete an amicable settlement or to obtain from the police the Repair Authorization with the official report and the copy of RCA policy belonging to the guilty party, if he/she agrees; Client must also give a written statement to the AEASY RENT headquarters.
8.5. In all the above cases the Client must check that all damage found are mentioned in the Repair Authorization.
8.6. In case of breach of procedure for damages, the Client is responsible for the full value of the repairs, immobilisation costs and costs arising from lack of use of the car.
8.7 In case of damages who have as consequence warranties retaining and the changement of the vehicle, for this new rental the Client is suppose to pay new waranties as for this new car conditions.
9.1. The terms of extension, cease or early termination of contract cannot be established without AEASY RENT consent.
9.2. Client’s intention to extend the contract shall be communicated to AEASY RENT, at least 24 hours before the expiration of the Contract. The tariff is paid in the same conditions agreed in the initial contract. The contract may be extended by written consent of both parties.
9.3. Contract is terminated de jure at the end of the lease.
9.4. The contract may be terminated before the expiry by the parties consent or as termination effect.
9.5. The Locator may cancel this contract with no prior formality and without putting in delay in the following situations:
a) Dissolution, liquidation, restructuring or starting of the bankruptcy procedure against the Client
b) Any legal starting of a criminal prosecution against his Client or the related representatives.
c) Client’s decease or loss of exercising capacities.
d) Failed observance of any clause agreed by the parties by concluding this contract.
9.6. Should the contract be terminated, EASY RENT shall notify the Client by phone or e-mail.
9.7. Both for pre-term cease and in the event of termination, the Client has the obligation to deliver the car within 12 hours from the time of termination.
10.1. The Client is rightfully put into delay for all its obligations assumed in the contract and non-respected in due time.
10.2. Any dispute arising out of or in connection with this Contract shall be settled first amicably and only in case of failure, the parties will address the competent courts in Bucharest.
103. For any dispute, this Contract constitutes proof.
10.4. The Locator reserves its right to recover from the Client any amount of money and the expenses occurred in the afferent recovery, according to the Romanian laws in force, concerning the compensation, consequently to the infringing by the Client of the obligations object of this contract.
